S Corporation? Beware of Ugly Tax Rules on Your Health Insurance

Question

I have a question about your November 2011 article on discriminating with health insurance for S corporation owners. Is the owner still eligible for the self-employed health insurance deduction on page 1 of his personal return if his S corporation discriminates?

Answer

Yes. The fact that the owner discriminates and gives all of the health insurance to himself and none to his employees simply triggers FICA and Medicare taxes on the owner, as explained in the November 2011 article you reference.
